THE Federal Court is due to re-hear an application by the Executive Council of Australian Jewry (ECAJ) against Adelaide Holocaust denier Dr Fredrick Toben, with a date to be set on Wednesday.

Dr Toben has failed to comply with a December 5 deadline set by the court in Sydney last month for him to remove all Holocaust denial material from the website of his Adelaide Institute.

DESPITE a last-minute reversal, Adelaide Holocaust denier Dr Fredrick Toben will be held to an order from the Federal Court of Australia last week that he remove all material denying the Holocaust from his Adelaide Institute website by 4 pm on Wednesday (December 5).

Executive Council of Australian Jewry (ECAJ)’s Jeremy Jones, the successful applicant in a Federal Court of Australia hearing, told The AJN this week that Dr Toben’s apparent backdown from an apology he gave for his contempt of court last Tuesday did not alter the circumstances.

Toben gives Holocaust denial apology in court

DR Fredrick Toben this week gave an apology in the Federal Court of Australia for being in contempt of court by continually featuring Holocaust denial material on his Adelaide Institute website.

He gave the apology during a contempt hearing of the Federal Court sitting in Adelaide on Tuesday.

After being called up to the bar by Justice Michael Moore to apologise if he agreed with it, Dr Toben began to give a qualified apology.

When Justice Moore said that his comments were inconsistent with an apology, Dr Toben gave a full apology, without embellishment and undertook to remove all Holocaust denial material from the website by 4pm on December 5 and not to replace it.

Toben’s day in court delayed

Holocaust-denier Fredrick Toben’s contempt of court hearing has been delayed until November 27, and will be heard in Adelaide.

The trial has been delayed so that neither party is disadvantaged by dependence on video-link during cross examination.

Toben to finally face Federal Court

THE Federal Court of Australia has appointed a barrister to represent South Australian Holocaust-denier Dr Fredrick Toben.

On September 24, the Federal Court in Sydney will hear a complaint by the Executive Council of Australian Jewry (ECAJ) that Dr Toben flouted the court’s September 2002 order not to post Holocaust-denial material on the website of his Adelaide Institute.

The Federal Court’s 2002 order was imposed after a landmark victory by the ECAJ against him.

Since proceedings were launched in the Federal Court in January, Dr Toben has said he has been unable to find legal representation. Previously he had engaged a lawyer who was later found to have had his practising certificate temporarily suspended.

Toben case to resume

Toben case resumes later this month

A DIRECTIONS hearing into a contempt case against Holocaust denier Dr Frederick Toben has been relisted for the Federal Court in Sydney on May 21.

The Executive Council of Australian Jewry (ECAJ) brought the case against Dr Toben of Adelaide earlier this year, alleging that he has repeatedly violated a 2002 Federal Court order prohibiting him from distributing Holocaust-denial material and posting it on his Adelaide Institute website.

Dr Toben, who initially conducted his own defence, later claimed he wanted a lawyer, but told a February 6 directions hearing that the only lawyer available to him could not practice until May, as his certificate of practice was suspended.

The ECAJ claimed Dr Toben’s continued publication of Holocaust-denial material on the website is in contempt of the Federal Court, which made its landmark 2002 ruling after a case spearheaded by then ECAJ president Jeremy Jones.

THE contempt case against Holocaust-denier Dr Frederick Toben has been set for September in the Federal Court.

Justice Michael Moore told the court today (Thursday) that he was “provisionally” scheduling the hearing for September 24-25 to hear the complaint brought by the Executive Council of Australian Jewry (ECAJ) against Dr Toben.

Dr Toben is accused of flouting a 2002 Federal Court order to remove Holocaust-denial material from his Adelaide Institute website.

HOLOCAUST revisionist Frederick Toben will launch a public appeal so he can defend a Federal Court action alleging his Adelaide Institute website raises doubts the Holocaust occurred.

Dr Toben, a retired high school teacher, said while he had financial backing from supporters, his legal defence would be expensive but he would not defend himself in court.

“It’s beyond me to defend myself,” Dr Toben said. British author David Irving defended himself when he attempted to challenge charges of Holocaust denial in Austria. Irving was jailed for nine months.

HOLOCAUST revisionist Frederick Toben is unable to find a lawyer to defend him against allegations he has raised “serious doubt” about the Holocaust on his Adelaide Institute website.

In a subpoena served on Monday night, Jeremy Jones - the former president of the Executive Council of Australian Jewry - asked the Federal Court to jail Dr Toben for breaching four-year-old court orders because his website suggests “it is unlikely that there were homicidal gas chambers at Auschwitz”.

Mr Jones also alleges the website imputes that Jewish people who were offended by Holocaust denial or challenged Dr Toben’s theories were “of limited intelligence”.
