Accused Nazi criminal fails to vary bail

Accused Nazi war criminal Charles Zentai failed in a court bid to vary his bail conditions on Tuesday, on the grounds that he is frail and has difficulty getting on and off buses.

Perth resident Zentai, 84, is fighting a request for his extradition to Hungary, where he is alleged to have murdered Jewish teenager Peter Balazs in 1944.

The case was due to be heard in the Perth Magistrates’ Court in February, but he has initiated a Federal Court challenge against the West Australian magistrates’ power to deal with commonwealth extradition laws.

While the federal case will not be heard until July, Zentai is still required to regularly appear in the Magistrates Court until the matter is resolved.

In one such appearance on Tuesday, Zentai’s lawyer, Michael Bowden, asked Magistrate Wayne Tarr to vary one bail condition - to allow his client to report to police by telephone instead of going to a Fremantle office once a fortnight.

Zentai has had two falls at home, did not drive, and had difficulty travelling on the bus, his lawyer said.

“Particularly getting on and off the bus,” Mr Bowden said.

Zentai had surrendered his passport and all his family lived in Perth, where Zentai has lived for about 56 years, Mr Bowden said.

Commonwealth prosecutor Daniel Morris opposed the bail variation application, saying there was no way to tell where Zentai was if he reported by phone.

Magistrate Tarr denied the application.

“It is only once a fortnight … (and) there are other ways to get around,” the magistrate said.

Zentai has denied the allegations brought against him by the Simon Wiesenthal Centre, an international Jewish human rights organisation, and his family has previously said he was too ill to be extradited.

He will reappear in the Perth Magistrates Court on September 22.
